VEVRAA Listing Exceptions: Start With Verification

For federal contractors covered by the Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA), listing employment openings with the appropriate employment service delivery system is an important recruitment obligation. But not every opening must be listed.

The challenge is applying an exception to the actual position—not simply accepting a label in an applicant tracking system. Before excluding a job, recruiters and compliance teams should confirm coverage, review the exception, and retain enough documentation to explain the decision.

Treat exception review as a distinct step before a requisition enters the posting queue. This helps prevent an unsupported classification from being copied across locations, business units, or recurring hiring campaigns.

Know Which Exceptions You Are Evaluating

VEVRAA’s mandatory job-listing requirement generally excludes executive and senior management positions, positions filled from within the contractor’s organization, and positions lasting three days or less. Each category requires a factual review.

Executive and Senior Management Positions

A leadership-sounding title is not enough. A “manager,” “director,” or “head of” designation should not automatically trigger an exclusion.

Review the position’s actual responsibilities against the applicable regulatory definition. If the classification is uncertain, ask your compliance lead or legal counsel to evaluate it before the recruiting team suppresses the listing.

For example, a “regional director” might oversee broad business operations or primarily coordinate individual customer accounts. Gather the current job description, reporting relationships, and decision-making responsibilities rather than inferring eligibility from the title alone.

Positions Filled From Within

Confirm that the position will genuinely be filled from within the contractor’s organization. Posting a role internally first does not necessarily make it exempt if the employer later recruits externally.

Build a checkpoint into the workflow: when an internal-only search becomes an external search, reassess the listing requirement promptly. Do not assume that an external referral or a former employee qualifies as an internal fill.

For example, if an internal promotion search produces no suitable candidate, the request to purchase external advertising should also trigger compliance review. Connect those approvals so the advertising team does not proceed while the requisition still carries an outdated internal-only designation.

Positions Lasting Three Days or Less

This exception concerns how long the position lasts—not how quickly recruiting expects to fill it or how briefly an advertisement runs.

Verify the anticipated duration using the assignment details. A temporary, seasonal, or contract label alone does not establish that the position falls within this exception. If the assignment changes or extends, revisit the determination.

A two-day event assignment and a month-long seasonal assignment require different assessments, even if both are labeled “temporary.” Record the planned start and end dates and identify who must report scheduling changes to the compliance reviewer.

What to Verify Before Excluding an Opening

Use a consistent review process rather than relying on individual recruiter judgment. Your checklist should address:

  • Coverage: Is the employer subject to VEVRAA’s mandatory listing requirement for this opening?
  • Exception: Which specific exception applies, and what facts support it?
  • Approval: Who reviewed and authorized the exclusion?
  • Evidence: Where are the job description, internal-fill details, or assignment dates recorded?
  • Changes: What event will trigger another review, such as external recruiting or an extended assignment?
  • Routing: If no exception applies, which employment service delivery system should receive the listing?

Documentation should make the reasoning understandable to someone who was not involved in the original decision. A checkbox without supporting facts may be difficult to evaluate later.

Create a Requisition-Level Decision Record

Keep the review with the individual requisition, not only in a general policy folder. A practical record includes the requisition identifier, work location, exception category, supporting facts, reviewer, and review date. Link supporting documents and preserve updates when the determination changes.

Use a status such as “pending compliance review” for unresolved cases rather than treating missing information as approval to exclude. Establish an escalation contact so uncertainty does not disappear into a recruiter’s inbox.

Keep Listing Compliance Separate From Advertising

A commercial job advertisement and a required employment service listing are not interchangeable. Posting on Craigslist, purchasing recruitment media, or searching resumes may support candidate outreach, but those activities do not automatically satisfy VEVRAA’s listing requirement.

Likewise, an exception from mandatory listing does not remove every other applicable VEVRAA obligation. Evaluate outreach, nondiscrimination, recordkeeping, and other requirements separately with qualified compliance guidance.

For distributed recruiting teams, establish clear ownership across recruitment process outsourcing providers, manual posting specialists, media buyers, and internal staff. Confirm who submits required listings and who retains submission records.

Check the Handoff Before Closing the Task

When an opening requires listing, distinguish a request sent to a posting provider from a completed submission. Agree on the evidence returned, how unsuccessful submissions are flagged, and who resolves missing information. Retain available confirmations with the requisition under your applicable records policy.

Periodically sample excluded openings against their supporting records. Look for title-based assumptions, internal searches that became external, and short assignments that were extended. Use those findings to improve instructions and training rather than simply adding another checkbox.
